Facebook Spammers Safe in Canada?

facebook_ad Friday, a U.S. federal Judge awarded Facebook damages totaling $873-million arising from a lawsuit against 32-year-old Adam Guerbuez.

A Facebook rep, Barry Schnitt, says that Guerbuez and his company, Atlantic Blue Capital, bombed the social-networking users with a megaton of sexually explicit spam messages. 

It’s unlikely Guerbuez will honor what the U.S. based social network says is the largest ruling in the history of the CAN-SPAM legislation that prohibits the distribution of mass e-mail messages that contain false or misleading information.

Social networks such as Facebook rely on advertising revenue. The more users they can attract, the more they can charge marketers for advertising. By spamming many of Facebook’s 120 million users, Mr. Guerbuez was basically destroying the value of Facebook.

“It’s certainly beyond his resources,” says Scnitt, “and we have no illusions about getting all of the money. We’re going to get whatever we can to the extent that he has resources, we’re going to try and seize them.”

However, because of Canada’s absence of anti-spam legislation Facebook could be “out of luck” in securing ANY of the nearly billion-dollar judgment!

“Ouch, Facebook, that’s gotta hurt!!” 

Guerbuez is no stranger to the law. In 1997, he was charged with uttering threats and agreed to a one-year restraining order.

In 2000, after a man was beaten to death in an unprovoked assault outside a Montreal bar, he and several others were arrested. Mr. Guerbuez was charged with assault causing bodily harm, and was acquitted by a jury.
